Terms of Service

These Terms of Service ("Terms") govern your use of the Salary Benchmark platform ("the Service") operated by Erda Group, SIA ("we", "us", or "the Company"), registration number 40103692668, registered at Elizabetes iela 4-2, Rīga, LV-1010, Latvia.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Salary Benchmark is a web-based platform that generates salary benchmark reports for the Baltic region (Latvia, Lithuania, Estonia). Users submit job descriptions which are classified using AI and matched against labor market data to produce salary range reports.
2. Eligibility
The Service is intended for business use by professionals aged 18 or older. By registering, you represent that you have the authority to bind yourself (or your organization) to these Terms.
3. Account
- You must provide accurate registration information (name, email, company name).
- You are responsible for maintaining the security of your email account, which is used for magic link authentication.
- You must not share your account or allow unauthorized access.
- We may suspend or terminate accounts that violate these Terms.
4. Reports and Pricing
- Reports are generated based on job descriptions you provide.
- Each report costs €150 (including applicable taxes). Prices are in EUR only.
- Payment is processed securely via Stripe. You may purchase reports individually or in batches.
- Once purchased, reports are permanently available in your account library.
- Invoices are generated automatically and accessible through the billing portal.
5. Refund Policy
Due to the digital nature of the reports, refunds are generally not provided once a report has been unlocked. If a report contains demonstrable errors caused by a platform malfunction, contact us at hello@erda.lv and we will evaluate your case within 14 days.
6. AI Processing and Data Accuracy
The Service uses artificial intelligence to classify job descriptions into ESCO occupation codes and generate salary benchmarks. While we strive for accuracy:
- AI classification is provided as a best-effort match with confidence percentages.
- Salary data is based on available market data and may not reflect all employers or positions.
- Reports are informational tools — they do not constitute professional compensation consulting advice.
- You are responsible for verifying the suitability of report data for your specific decisions.
7. Acceptable Use
You agree not to:
- Submit false, misleading, or unlawful content as job descriptions.
- Attempt to reverse-engineer, scrape, or extract the underlying salary data.
- Use the Service to discriminate against employees or candidates.
- Resell, redistribute, or publicly republish reports without our written consent.
- Attempt to circumvent authentication, security measures, rate limits, or payment requirements.
- Send automated requests that exceed the published rate limits or otherwise abuse the Service's API endpoints.
8. Rate Limiting
To ensure fair access and protect the Service from abuse, we enforce rate limits on API requests. If you exceed the allowed number of requests within a given time window, you will receive a temporary "429 Too Many Requests" response. Normal access resumes automatically after the rate limit window resets. Rate limit data is processed by Upstash, Inc. — see our Privacy Policy for details.
9. Intellectual Property
The Service, its design, code, and branding are owned by Erda Group, SIA. Salary benchmark reports generated for you are licensed for your internal business use. You may share report data within your organization but may not publicly republish or resell reports.
Job descriptions you submit remain your property. By submitting them, you grant us a limited license to process them for report generation purposes only.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free operation of the Service.
- Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, or consequential damages, including lost profits or business decisions made based on report data.
11. Termination
- You may stop using the Service and request account deletion at any time by contacting hello@erda.lv.
- We may suspend or terminate your account for violations of these Terms, with notice where practicable.
- Upon termination, your access to reports ceases. We retain payment records as required by law (see Privacy Policy).
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before taking effect. Continued use after changes constitutes acceptance. If you disagree, you may terminate your account.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Latvia. Any disputes shall be resolved in the courts of Riga, Latvia. If you are a consumer in the EU, you retain the right to bring proceedings in your country of residence and benefit from mandatory consumer protection laws of your jurisdiction.
